Drugged driving is the latest point of focus for the police types in Reno and in Lake Tahoe, Nevada. Especially in Incline Village and Crystal Bay, the Sheriff's deputies will use many pretexts to stop your clients, and in my experience, they look for any reason to bootstrap a simple speeding offense (5 mph over the posted limit is okay to stop under Whren vs U.S.) into a full blown Drug Recognition Evaluation, with the goal being to do a blood or urine test on the driver.

The mere presence of low level quantities of marijuana metabolites (no actual THC) in the blood or urine can result in a conviction of DUI. The moral of the story? Don't admit drug use, even if that drug use took place in California last week. Since THC and its metabolites are fat soluble, they can remain in the body for weeks. At least with no admissions, the Motion to Suppress is easier to get on.
