I received a 10 yr denial of driving privleges in MO fo a 3rd DUI. First, I would like to know if I have any chance to appeal this. My attorney did not show up for my hearing and come to find out he was in jail. The 1st offense related to this action was a BAC about July 29, 1992, which had this been before July 1, 1992 would not have counted and therefore 10yr denial would not apply. Second, because I am actually no longer revoked or suspended and am only denied privleges in MO, can I get a drivers license in another state? If so, in any state or just specific states?
I would greatly appreciate any help you could provide, as this has completely changed my life in a very negative way.
Ten year denials have a lifetime lookback. Any three convictions lifetime will trigger the revocation. The date of the offense is irrelevant because they will consider all lifetime convictions. You have very limited time to appeal after the hearing before it is final. Most states are members of what is called an interstate compact. There are actually two interstate compacts. You are not supposed to be able to get licensed in one state where you are suspended in another, but that is not to say that it sometimes does not happen if you are not run on the driver's registry prior to getting the new driver's privilege. It probably happens from time to time when one falls through the cracks, but I would not count on it. Sorry to be the bearer of bad news. You can get a hardship to drive to work the last 7 years of the suspension after serving three if you have not had a felony or two or more refusals. Unfortunately, most people on these types of actions have one or both, and have to serve the hard 10 without even a work permit. Best of luck to you. Matt Guilfoil
