Quick question, am a little confused about this whole ordeal
Went to Miami Dade court for jury trial and because one of the arresting officers did not show up, the case was dismissed, no penalties assessed, this was the second time that an officer involved in the case did not appear.
Certified judgement read as follows: Dismissed for lack of prosecution - officer/witness
However I was informed by my defense attorney that the prosecution can re-open the case at a later date by delivering a summons to me. Does anyone know how likely this is, I was told that they have a year to do this from the arrest date, which was earlier this year.
If anyone has any insight into this I would be really grateful - should I be looking over my shoulder for a summons or is it normal for them to let it go.
Right now when I check the system it says CLOSED and bail deposit is ready to be released.
I hate to be the bearer of bad news, but I would certainly be setting aside some money to pay a good lawyer down there for when the case is refiled. I would be shocked if it were not refiled under these circumstances. Best of luck in it. J. Matthew Guilfoil www.guilfoillawgroup.com
