  1. Do not answer any questions other than your name and address.
  2. Be polite, but do not answer any questions designed to make you incriminate yourself (i.e.—where have you been, are you drinking, how many drinks have you had, are you intoxicated, etc.).
  3. Do not agree to perform roadside field sobriety tests (the one-leg stand test, the walk and turn test, the horizontal gaze nystagmus eye test, or any other test the officer makes up: i.e.—alphabet, etc.).
  4. Do not agree to have your eyes tested.
  5. Do not agree to blow into a handheld, roadside portable breath tester.
  6. Do consent to a blood, breath or urine chemical test, if you are asked to take one IF YOU ARE PLACED UNDER ARREST, UNLESS:

A.     you have a commercial driver’s license (CDL) and were driving a commercial vehicle at the time of the stop;


B.      you are less than 21 years old and believe you will register alcohol in your system;


C.     you were involved in an accident resulting in any injury to ANYONE;


D.     you have had any prior alcohol-related traffic contacts resulting in convictions, pleas, probation, etc. in the last five years. You should refuse the test if this is your third offense or greater, especially if it is your third offense or greater within ten years of the date of your first alcohol-related traffic arrest;


E.      but ask to speak with an attorney after being asked to take the test PRIOR to taking it. The police have to give you twenty minutes to contact an attorney in Missouri, but they don’t have to advise you of this right. ASK FOR IT!



  1. if you submit to a chemical test where none of the above apply: (REFUSE IF ANY OF THE ABOVE (5 a-d) APPLY) you have a right to a second, independent test at your own expense, but the police also do not have to advise you of this right or give you access to an independent test unless you ask for it.

 .       Demand an independent test no matter what the result of the police test at your own expense at a hospital, and it is better if it is a blood test.


A.     TALK TO YOUR ATTORNEY ABOUT THE INDEPENDENT TEST WHEN YOU CALL TO ASK IF YOU SHOULD TAKE THE POLICE TEST. If the police will not release you to a hospital, do whatever it takes to have a doctor or nurse come give you the independent test at the police station. If you don’t know one, discuss it with your attorney when you call, but make sure you get your own test at all costs!


B.      Pay for the test with your own money by whatever means necessary to help your case later. The police probably do not have to transport you to a hospital, and they definitely don’t have to pay for it. Do what you have to do to not waive this right.



  1. Be polite at all times. Produce the requested documents.
